Terms of Service

These terms govern use of the Medipay platform by healthcare practices and their staff ("you"). By creating an account or using the platform you agree to them. Where you have a separate signed agreement with Medipay UK, that agreement takes priority over these terms.

1. The service

Medipay provides software for taking and managing patient payments: payment links, a virtual terminal, instalment plans, receipts, reminders, reporting and integrations. Card payments are processed by regulated third parties: a PCI DSS certified payment gateway and the acquiring bank assigned to your practice. Your practice is the merchant of record for its transactions. Medipay is not a bank and does not hold your funds; settlement is made by the acquirer under its terms.

2. Your account

Keep sign-in credentials confidential and use the role controls to limit what staff can do. You are responsible for activity under your workspace, for the accuracy of payment requests you create, and for having a lawful basis to give Medipay the patient contact details you use for links, receipts and reminders.

3. Acceptable use

The platform may only be used for legitimate healthcare payments. Do not use it for unlawful transactions, to send unsolicited marketing, to attempt to access other workspaces, or to probe or disrupt the service. We may suspend accounts that put patients, practices or the platform at risk.

4. Fees

Transaction and service fees are as agreed with Medipay in your order form or pricing schedule. Acquirer and gateway charges are set by those providers under their agreements with you.

5. Data

Our Privacy Policy explains how data is handled. For patient data your practice provides, you are the controller and Medipay acts as your processor: we process it only to provide the service, keep it secure, and assist you with access and erasure requests.

6. Availability and changes

We aim for high availability but the service is provided "as is" and may occasionally be interrupted, including by our hosting, gateway or acquiring partners. We improve the platform continuously and may add, change or retire features; we will not materially reduce the core service without reasonable notice.

7. Liability

Nothing in these terms limits liability that cannot be limited by law. Otherwise, Medipay is not liable for indirect or consequential loss, and our total liability in any 12 month period is limited to the fees you paid Medipay for the service in that period. Card processing, settlement and chargebacks are governed by your agreements with the gateway and acquirer.

8. Termination

You may stop using the platform at any time. Either party may end the arrangement on notice; we may suspend immediately for serious breach or security risk. After termination we retain financial records for the legally required period and you may request an export of your data.

9. General

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If any provision is found unenforceable, the rest remain in force. We may update these terms; the date above shows the current version, and material changes will be notified in the portal.
